  In most car accidents, there is little confusion as to whose fault it is. Although it is usually easy to determine who’s at fault, it can be far trickier to determine who is liable for the damages.
Be sure to get clarity on your car insurance company’s rules regarding liability if a friend or someone else uses your car with your prior consent. Generally speaking, your own car insurance policy will largely cover the damages caused by your friend if they are involved in an accident while driving your car.

Most South African car insurance companies make insurance cover provisions for designated drivers; yet if the accident is more serious and involves grievous physical harm, for example, your friend’s car insurance will probably cover the medical costs of the person(s) involved, up to the limits of their policy’s cover.

Should you get sued, a personal liability insurance policy will cover the cost of your legal fees up to the limit of your insurance policy. From there onwards, you will be responsible to cover these fees on your own.

Never lend your car to someone who does not have their own car insurance! If you do and they are involved in an accident involving bodily harm to another person, you may have to foot the legal bills in your personal capacity.

If you can prove that you did not loan the vehicle to the person that crashed it, or that this driver used your car without your explicit consent, you will may probably not be required to use your car insurance policy for cover.

Should your car get stolen and then be involved in an accident, you will probably have to pay an excess and any shortfalls required to pay for repairs.
